Florida Criminal Offenses Which May Not Be Sealed or Expunged

The following offenses, set forth in Florida Statutes § 943.0585 and § 943.059, cannot be expunged or sealed in the State of Florida, regardless of the disposition of the charges:

  1. Luring or Enticing a Child ( 787.025)
  2. Sexual Battery and related offense (Chapter 794)
  3. Procuring person under 18 for prostitution ( 796.03)
  4. Lewd or lascivious offenses committed upon or in the presence of persons less than 16 years of age ( 800.04)
  5. Voyeurism ( 810.14)
  6. Violations of the Florida Communications Fraud Act (Scheme to defraud or Organized Fraud as defined in 817.034)
  7. Lewd or lascivious offenses committed upon or in the presence of an elderly person or disabled adult ( 825.1025)
  8. Sexual Performance by a child ( 827.071)
  9. Offenses by public officers and employees (Chapter 839)
  10. Giving/showing/transmitting/loaning obscene materials to a minor ( 847.0133)
  11. Computer pornography (child related) ( 847.0135)
  12. Selling or buying of minors ( 847.0145)
  13. Drug Trafficking ( 893.135, which does not include possession)
  14. Sexual misconduct with mentally deficient or mentally ill defendant and related offenses.
  15. A violation of any offense qualify for registration as a sexual predator under 775.21 or for registration as a sexual offender under § 943.0435.
  16. Violations of Pretrial detention or release ( 907.041)
  17. Arson ( 806.01)
  18. Aggravated Assault ( 784.021)
  19. Aggravated Battery ( 784.045)
  20. Illegal use of explosives ( 790.001)
  21. Child abuse or aggravated child abuse (Chapter 827)
  22. Abuse of elderly person or disabled adult, or aggravated abuse of an elderly person or disabled adult
  23. Aircraft Piracy
  24. Kidnapping (Chapter 787)
  25. Homicide (Chapter 782)
  26. Manslaughter ( 782.07
  27. Robbery ( 812.13)
  28. Carjacking ( 812.133)
  29. Sexual activity with a child, who is 12 years of age or older, but less than 18 years of age, by or at solicitation of a person in familial or custodial authority ( 827.071)
  30. Burglary of a dwelling ( 810.02)
  31. Stalking and aggravated stalking ( 784.048)
  32. Act of Domestic Violence as defined in 741.28
  33. Home invasion robbery ( 812.135)
  34. Act of terrorism as defined by 775.30
  35. Manufacturing any substances in violation of Chapter 893
  36. Attempting or conspiring to commit any of the above crimes
