Eligibility for Felony Reductions in California

What is a “Wobbler”?
A “Wobbler” is a term frequently used in California criminal law to describe a crime that could be charged as either a misdemeanor or felony, meaning, the prosecutor has discretion on the severity of the charges they choose bring against you. Typically, a prosecutor will consider the specific facts and circumstances of the case, along with your criminal history when making this determination. There are many criminal offenses which are considered “Wobblers” in California, ranging from violent crimes such as assault with a deadly weapon to white collar crimes like money laundering.
Effects of Felony Reductions

Hi my name is Dustin Carl and some time ago maybe three four five years ago I had my entire record expunged including the felony. I was arrested for drug sales and they said it was not a wobbler so therefore I could not get my felony reduced to a misdemeanor. 10 years ago ivwas arrested for having a baseball bat in my motorhome with my tools. i had 2 previous convictions for simple posession of a controlled substance and tvose are both misdemeanors now because of prop 47. i got cleaned up and have had zero legal issues in a decade, but now i see that because of that “posession of a deadly weapon” felony, im still a convicted felon. iv never been accused of thieft, sales, or assault, i literally only ever got in trouble because of things that i had in my posession. i was using the bat to do auto body work, and i told the police that, but they said that the fact that it was not being used to play sports made it a felony. is there away to fix this? thanks. 🙂
